CAGAYAN DE ORO CITY – For illegally sharing photos and videos of his wife, a foreign national was arrested by operatives of the Regional Anti-Cybercrime Unit-10 (RACU-10) during an entrapment operation here March 30, the police said Thursday.

According to a report posted by Brig. Gen. Benjamin Acorda Jr., regional police director, on his Facebook page, the suspect was a 61-year-old Danish citizen, and a resident of the city.

The report said the suspect was arrested at a condominium complex in the city’s uptown district.

The police have withheld the names of both suspect and his victim, a 36-year-old Filipino female, said to be the suspect’s wife.

Lt. Col. Michelle Olaivar, police regional spokesperson, said the identities of those involved in the case are protected under the Section 44 of the Republic Act 9262, also known as the Anti-Violence Against Women and their Children Act of 2004.

Investigators said the suspect will be facing charges for violation of Republic Act 9995 or the Anti-Photo and Video Voyeurism Act of 2009, and RA 9262 in relation to Section 6 of the Republic Act 10175, the Cybercrime Prevention Act of 2012.

The victim told authorities that the suspect allegedly shared her sexually explicit videos and photos among her friends for the reason that the suspect wanted to continue their relationship and wanted her back.

Olaivar said the suspect has been living in Cagayan de Oro for four years where he met the victim.

Although it was not clear when the suspect and victim got married, Olaivar said the couple separated on March 5, 2022.

She added the couple has been on an on-and-off relationship.

“The victim wanted to separate from her husband due to instances of abuse,” Olaivar said.

Confiscated during the operation was a laptop containing the said videos and photos of the victim.

“There are no exemptions to the rule of law, whether that person is a foreign national or not, so long as he violated and made illegal activities in our area of jurisdiction, we will take appropriate action to it,” Acorda said in a statement.

“Other people take advantage on the use of technology for illegal means, kaya mas lalong pinaigting ng ating kapulisan ng Police Regional Office 10 in apprehending those individuals who continue to pursue unlawful acts,” the regional director added.
