DAVAO CITY — The provincial Prosecutors Office of Davao del Norte court dismissed the cyberlibel case against Governor Edwin “Kuya Gov” Jubahib filed by Vice Governor De Carlo “Oyo” Uy due to a lack of evidence to merit the prosecution of the case.
In a decision handed down by Provincial Prosecutor Norman Solis on January 29, 2024, it cited “the complaint does not have sufficient basis” against Jubahib.
The same resolution stated that the Jubahib did not intend to damage anyone’s reputation since the respondent issued a warning for the people not to be victimized by the scheme and instead guided the beneficiaries who filed a complaint to find justice.
“The complaint stemmed from a social media post on the page “Kuya Gob Edwin Jubahib” on October 31, 2023, the Governor alleged that a big scam happened in the province during the October Barangay Elections.
The post mentioned about anomaly in the distribution of the government’s subsidy or Ayuda through the Department of Social Welfare and Development (DSWD) to the poor beneficiaries.
The same scam was investigated by the Senate.
Jubahib said the distribution became a tool for some politicians to rob the people of the money they deserved and in turn fattened the pockets of the unscrupulous politicians.
In his counter-affidavit, Jubahib attached dozens of ‘affidavits’ of the victims and the witnesses when the alleged scam took place.
With the dismissal, Jubahid said “Justice prevails, the truth will set us free and God is Good all the time because the Senate conducted a probe on the issue.”
