DAVAO CITY (July 25) — he Supreme Court has thrown out the impeachment case filed against Vice President Sara Duterte, declaring the Articles of Impeachment unconstitutional.
In a press briefing on Thursday, Supreme Court spokesperson Atty. Camille Ting said the high court found that the House of Representatives violated Duterte’s right to due process and broke the constitutional one-year bar rule, which prohibits filing more than one impeachment complaint against the same official within a year.
Because of these violations, Ting said, the Senate cannot acquire jurisdiction over the case, meaning the impeachment trial cannot proceed.
However, the Supreme Court clarified that its ruling does not prevent the filing of a new complaint after the one-year period has passed.
The decision is a legal win for Vice President Duterte and underscores the importance of following constitutional procedures in impeachment processes.
