ICC Allows More Evidence in Duterte Case, Sets Feb. 13 Deadline Ahead of Key Hearing

DAVAO CITY (February 13)  — The International Criminal Court (ICC) has approved requests from both the prosecution and defense to expand their evidence lists in the case against former President Rodrigo Duterte—just days before a crucial confirmation of charges hearing.

In a public decision dated February 10, 2026, Pre-Trial Chamber I granted the defense’s request to add 78 new items to its evidence list. The prosecution was also allowed to submit two additional pieces of evidence.

The development comes less than two weeks before the confirmation of charges hearing scheduled for February 23, 2026—a pivotal stage that will determine whether the case moves forward to full trial.

The three-judge panel, presided over by Judge Iulia Antoanella Motoc, underscored the importance of the ruling in ensuring a fair and comprehensive confirmation process.

The Chamber has ordered both the prosecution and the defense to submit their updated and final lists of evidence no later than Friday, February 13, 2026.

What Happens Next?

The February 23 hearing will determine whether prosecutors have presented sufficient evidence to establish substantial grounds to believe Duterte is responsible for the alleged crimes under ICC jurisdiction. If confirmed, the case will proceed to trial.
