NTC, Kongreso gipatubag sa petisyon sa ABS-CBN

DAKBAYAN SA DABAW — Ang Korte Suprema (SC) sa ilang en banc nga session karong Martes, Mayo 19, mituki sa petisyon nga gipasaka sa ABS-CBN batok sa “cease and desist order” nga giluwatan sa National Telecommunications Commission (NTC).

Sa usa ka pamahayag nga gipadala sa mga tigbalita, si SC spokesperson Brian Keith Hosaka nag-ingon nga ang Senado ug ang House of Representatives gimanduan sa korte sa pagtubag sa maong petisyon sulod sa napulo ka adlaw human nadawat ang notisya.

Ang Korte Suprema nagmando usab sa NTC sa pag-sumiter sa ilang tubag sa petisyon sa ABS-CBN sulod gihapon sa napulo ka adlaw human nadawat ang notisya.

Sa susamang higayon, gimanduan usab ang NTC sa pagtubag sulod sa lima ka adlaw sa mga komentaryo sa Senado ug House of Representatives.

Sa laing bahin, gihangop ni Solicitor General Jose Calida ang inisyatibo sa Kongreso nga sugdan na ang proceso sa pagtuki kung hatagan ba o dili ang ABS-CBN og “legislative franchise.”

Matud pa ni Calida, ang maong lakang susama sa iyang baruganan nga ang prankisa gikinahanglan sa pag-operate og istasyon sa radyo ug telebisyon, ug ang Kongreso ang adunay bugtong gahum nga mohatag sa maong prankisa.

“This move is consistent with the position of the Solicitor General that a franchise is required to operate radio and television stations in the Philippines. Congress has the exclusive and plenary power to grant that franchise, which must be specifically in the form of a statute,” si Calida nag-ingon.

Niadtong Abril 30, gipahinumduman ni Calida ang NTC nga dili mahimong makahatag og “provisional authority” tungod kay walay balaud nga nagsuporta niini.

Dugang ni Calida nga uyon usab siya sa gisulti ni Speaker Alan Cayetano nga kinahanglang imbestigahon ang mga giingong kalapasan sa ABS-CBN. (LBG)
